These Terms apply to your use of our website and to your interactions with Ella Kate Jewelry, including:

• Website use and browsing
• Consultations
• Estimates and quotes
• Custom design services
• Purchases
• Diamond Drops and limited releases
• Warranty or service requests
• Other interactions with Ella Kate Jewelry

Specific written order details, invoices, design approvals, product pages, or written agreements may contain additional terms that apply to a particular transaction.

The more specific written terms provided for the particular transaction will control to the extent of the conflict, subject to applicable law.

You agree to provide accurate and current information when submitting orders, inquiries, consultation requests, ring calculator information, shipping information, and payment information. You are responsible for making sure the information you provide is accurate and kept up to date.

You may not use our website for:

• Fraudulent activity
• Unauthorized access to any system or account
• Interference with the operation of the website
• Introducing malicious software
• Using false identities or impersonating others
• Any unlawful purpose
• Infringing another person's rights

The Ella Kate Jewelry Ring Calculator is intended to provide a starting estimate based on the selections entered. Calculator results are not a binding quote, offer, appraisal, or guaranteed final price.

Actual pricing may vary based on factors such as:

• Exact diamond or gemstone availability
• Stone specifications
• Metal prices
• Design complexity
• Labor
• Material requirements
• Engineering requirements
• Special requests
• Changes to specifications

Website examples, educational information, photographs, renderings, measurements, and estimated prices are provided to help customers understand their options but may not represent every characteristic of a finished custom piece.

Once Ella Kate Jewelry reviews and confirms a design and provides a final custom quote, that quote is valid for 7 days unless otherwise stated in writing.

Gold, diamond, gemstone, and other material prices can fluctuate, so a quote may need to be updated if the customer does not move forward within the stated quote period. A Ring Calculator estimate is not the final quote, and the 7-day period applies only to a confirmed final quote issued after review.

All prices are in U.S. dollars unless otherwise stated.

Applicable sales tax, shipping charges, optional services, warranty plan charges, and special sourcing costs may be added where applicable.

Our custom design process generally follows this sequence:

1. You discuss your design direction and specifications with Ella Kate.
2. Ella Kate establishes the design direction and pricing.
3. You move forward by paying the required 50% deposit or completing the purchase through an available third-party financing partner such as Klarna or Affirm.
4. Ella Kate creates the final rendering/CAD for approval.
5. You review and approve the final design.
6. Production begins.
7. Ella Kate completes the jewelry.
8. Ella Kate may send final photos or video of the completed piece.
9. Any amount owed directly to Ella Kate Jewelry must be paid before shipment. If the customer financed the purchase through an approved third-party provider such as Klarna or Affirm, the customer will continue making payments directly to that provider according to the financing plan selected and does not need to pay off the financing balance solely because the jewelry is ready to ship.
10. The completed piece is shipped using Ella Kate's applicable insured shipping method.

Customers are responsible for carefully reviewing the final rendering, CAD, specifications, measurements, stone details, metal selection, ring size, engraving, and other design details provided for approval.

Approval of the final rendering is confirmation that the customer authorizes Ella Kate Jewelry to produce the piece based on the approved design.

Once the final rendering has been approved and production begins, design changes cannot be made during production.

If a customer requests changes after the finished piece has been completed, Ella Kate Jewelry may review whether the requested modification is possible. Additional labor, materials, shipping, stone costs, or remake charges may apply. Some modifications may require the piece to be partially or completely remade. Customer-requested modifications are not covered by the complimentary warranty.

CAD renderings + finished appearance

CAD renderings are technical representations used to communicate and manufacture a design. Certain structural elements, including prongs, settings, galleries, supports, and metal thicknesses, may appear more pronounced in a CAD rendering than they do after casting, setting, finishing, and polishing.

Minor visual differences between a digital rendering and a hand-finished piece are not necessarily defects. This does not apply to a finished piece that materially differs from the approved specifications.

Custom orders generally require a 50% deposit before the final rendering is created and the custom process proceeds, unless the customer completes the transaction through an approved third-party financing option or Ella Kate agrees otherwise in writing.

Because custom work requires design time, sourcing, materials, and production resources specific to the customer's order, custom deposits are generally non-refundable once paid and work on the custom order has begun, except where required by applicable law or where Ella Kate Jewelry agrees otherwise in writing.

Any remaining amount owed directly to Ella Kate Jewelry is due once the finished jewelry is complete and must be paid before shipment. Customers using an approved third-party financing provider such as Klarna or Affirm will continue making payments to that provider according to the financing agreement selected. A third-party financing balance does not need to be paid off solely because the jewelry is ready to ship. Ella Kate Jewelry may delay shipment until amounts owed directly to Ella Kate Jewelry have cleared.

Ella Kate Jewelry does not operate an internal payment plan.

Financing may be available through independent providers including Klarna and Affirm.

Eligibility, approval, credit decisions, payment schedules, interest, fees, and financing terms are determined by the financing provider and are subject to that provider's terms.

Ella Kate Jewelry does not guarantee approval, does not control credit decisions, and may not know why an application was declined. Information you submit to a financing provider may also be governed by that provider's own terms and privacy policy.

Ella Kate Jewelry may sell or work with laboratory-grown diamonds, natural diamonds, gemstones, gold, platinum, and other jewelry materials. We identify material and stone information as accurately as reasonably possible in product descriptions and order details.

Laboratory-grown diamonds will be described as laboratory-grown, laboratory-created, or similar terminology rather than represented as mined diamonds.

When a diamond or gemstone is sold with an independent grading report or certification, the applicable report information will be provided or identified as appropriate for that piece.

Measurements, carat weights, color, clarity, cut, ratios, and stone appearance can have normal tolerances where applicable. This does not change the specifications promised for a specific order.

Jewelry is a physical product created through casting, stone setting, polishing, finishing, fabrication, and other jewelry-making processes.

Very small variations that are inherent to production and hand finishing may occur. Examples include minor differences in polish, texture, engraving appearance, positioning, and finishing.

Finished jewelry should still materially conform to the approved order specifications. A material deviation from the approved design is not acceptable variation.

Custom ring production generally takes approximately 4–8 weeks after final design approval, depending on the complexity of the design and the time of year.

This is an estimate rather than an absolute guarantee. Timing may be affected by:

• Design complexity
• Stone sourcing
• Material availability
• Holidays
• Production volume
• Quality-control adjustments
• Unexpected manufacturing issues

If we become aware that an order cannot ship within a promised timeframe, we will notify you and work with you on next steps. Nothing here limits rights you may have under applicable law regarding delayed shipment.

Completed jewelry is generally shipped fully insured and signature is required upon delivery.

Ella Kate Jewelry currently ships only within the United States. Insured U.S. shipping is $25 when the merchandise subtotal is under $1,000 and complimentary when the merchandise subtotal is $1,000 or more. Eligibility is based on the merchandise subtotal after discounts and before tax and is calculated at checkout.

Customers are responsible for providing an accurate shipping address, providing information necessary for delivery, and arranging to receive and sign for the package.

Carrier events such as severe weather, service disruptions, customs, address issues, and carrier delays may affect transit times. Carrier delivery estimates are not guarantees by Ella Kate Jewelry.

If a shipment is lost, damaged, materially delayed, or otherwise experiences a delivery problem, contact Ella Kate Jewelry promptly so we can work with the carrier and determine the appropriate next steps.

Because many Ella Kate pieces are custom, made to order, personalized, specially sized, engraved, or otherwise created for a particular customer, eligibility for cancellation, return, exchange, or refund may be limited.

Any product-specific return, final-sale, cancellation, or refund terms disclosed on the applicable product page, invoice, order communication, or written agreement are incorporated into these Terms.

Once production has begun following final design approval, cancellation may not be available because the piece is being produced specifically for that customer.

If you believe your finished jewelry materially differs from the approved specifications or has a manufacturing issue, contact Ella Kate Jewelry promptly so we can inspect the piece and determine the appropriate resolution.

Nothing in these Terms limits rights or remedies that cannot legally be waived.

Ella Kate Jewelry may release limited collections or “Diamond Drops” that can include rings, earrings, bracelets, necklaces, other jewelry, one-of-one pieces, or small limited runs offered at special Drop pricing.

• Availability is limited and is not guaranteed until checkout is successfully completed
• Drop pricing applies only to the applicable Drop item
• Sold-out products may no longer be available at Drop pricing

If a sold-out Drop ring can be recreated as a custom order, the custom version will be priced at current custom pricing rather than the original Drop price.

Where a Drop item is specifically identified as Final Sale, that product-specific final-sale condition applies to that item.

Ella Kate Jewelry's complimentary lifetime warranty provides eligible setting repairs, resizing, and professional cleaning at no service charge, subject to the warranty terms. Customers are responsible for applicable shipping to and from Ella Kate Jewelry.

The complimentary warranty is not jewelry insurance and does not cover a completely lost or stolen ring or automatically replace lost stones.

Optional paid stone-coverage plans may provide additional benefits subject to their own terms and coverage periods.

Ella Kate Jewelry may photograph or record jewelry and custom pieces that we design, create, repair, resize, or otherwise handle while the jewelry is in our possession, including before shipment or delivery.

Unless otherwise agreed in writing, Ella Kate Jewelry may photograph and use photographs or video created by or for Ella Kate Jewelry of the jewelry itself for our portfolio, website, social media, advertising, marketing, educational materials, promotional content, press, and other legitimate business purposes.

This permission includes photographs or videos of custom and one-of-a-kind jewelry created for a customer.

No additional compensation is owed to the customer for Ella Kate Jewelry's permitted use of photographs or video created by or for Ella Kate Jewelry of the jewelry itself.

Ella Kate Jewelry will not intentionally publish a customer's name, contact information, or other directly identifying personal information with those product images unless separately authorized.

Where a piece contains a name, personal date, coordinates, or other information that could identify or reveal private information about a customer, Ella Kate Jewelry may crop, obscure, avoid highlighting, or otherwise handle those details appropriately in public-facing content.

This provision does not give Ella Kate Jewelry ownership of photographs created and owned by a customer, wedding photographer, or other third party. Customer-submitted images are addressed below.

Customers may submit content to us, such as:

• Inspiration photos
• Screenshots
• Drawings
• Reference designs
• Wedding photos
• Proposal photos
• Messages and other content

By submitting content, you represent that you have the right to provide it for the purpose for which you submit it.

Ella Kate Jewelry may use submitted content internally as reasonably necessary to understand the design request, create the order, communicate with the customer, provide service, and maintain project records.

Ella Kate Jewelry may request separate permission before publicly posting customer-submitted photographs that feature identifiable people.

Ella Kate Jewelry owns or licenses applicable:

• Trademarks and brand names
• Website copy and logos
• Photography, video, graphics, and illustrations
• Educational content and website design
• Original renderings, CAD materials, sketches, and design assets

You may not reproduce, sell, distribute, commercially exploit, or falsely claim ownership of Ella Kate Jewelry-owned content without permission.

Unless Ella Kate Jewelry expressly agrees otherwise in writing, purchasing a physical piece of jewelry does not transfer ownership of Ella Kate Jewelry's underlying CAD files, production files, renderings, manufacturing methods, or other proprietary design materials.

Unless exclusivity is specifically agreed to in writing, a custom jewelry purchase does not by itself grant the customer exclusive intellectual-property rights in the general jewelry style, setting concept, combination of common design elements, or future similar designs.

Nothing in this section claims ownership over intellectual property that legally belongs to another party.

Promotions may have separate terms. Discounts may have start and end dates, eligibility may be limited, offers may not be combined unless specifically stated, and promotional pricing does not necessarily apply retroactively.

The current 10% wedding band discount applies to the wedding band when it is ordered at the same time as the engagement ring.

We work to keep pricing, product specifications, availability, images, and descriptions accurate. Mistakes can still occur.

Ella Kate Jewelry may correct obvious errors or update information where appropriate, subject to applicable law and the rights attached to any completed transaction.

Limited products may sell out, and website inventory or availability is not guaranteed until a transaction has been successfully completed.

Our services may involve independent providers such as Shopify, Klarna, Affirm, Calendly, payment processors, shipping carriers, and other integrations. Those providers may have their own terms, policies, and eligibility requirements.

Ella Kate Jewelry is not responsible for the operation of third-party websites or services outside its control, subject to applicable law.

You may not:

• Interfere with website operation
• Attempt unauthorized access
• Introduce malicious code
• Scrape or exploit the website unlawfully
• Impersonate others
• Submit fraudulent payment information
• Infringe intellectual property
• Use the site for illegal activity

Ella Kate Jewelry may restrict access where reasonably necessary to protect the website, the business, or other users.

Except for warranties expressly provided by Ella Kate Jewelry and rights that cannot be excluded under applicable law, the website and informational content are provided on an “as available” basis.

This section does not limit or replace the express warranty Ella Kate Jewelry provides for its jewelry or any other obligation we have specifically committed to in writing.

To the fullest extent permitted by applicable law, Ella Kate Jewelry will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or a transaction with Ella Kate Jewelry.

To the fullest extent permitted by law, Ella Kate Jewelry's aggregate liability arising from a particular product or service will not exceed the amount actually paid to Ella Kate Jewelry for the product or service giving rise to the claim.

These limitations do not apply where prohibited by law.

You agree to be responsible for losses or claims caused by your unlawful use of the website, your violation of these Terms, infringement caused by content you knowingly provide, or your fraudulent conduct. This does not apply to claims arising from Ella Kate Jewelry's own conduct.

Some events are outside our reasonable control, including natural disasters, severe weather, carrier disruptions, supplier interruptions, material shortages, labor disruptions, government actions, widespread technology outages, and similar circumstances.

Ella Kate Jewelry will not be responsible for delay or failure caused by events outside our reasonable control to the extent permitted by law, but we will communicate material delays and work toward an appropriate resolution.

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles, except to the extent another jurisdiction's mandatory consumer-protection law applies.

If a dispute arises, we encourage you to contact Ella Kate Jewelry first so we can try to resolve the issue directly.

We may update these Terms & Conditions from time to time as our business, services, website, or legal obligations change. The updated Terms will be posted on this page with a revised “Last updated” date.

The terms that applied at the time of a completed transaction continue to govern that transaction where appropriate.

Severability

If one provision is unenforceable, the remainder continues to apply to the extent permitted by law.

No waiver

Failure to enforce a provision once does not automatically waive it.

Assignment

Customers may not assign contractual rights or obligations related to a custom order without consent where applicable.

Entire agreement

These Terms, together with order-specific written terms, invoices, approved specifications, applicable product policies, our Privacy Policy, and our Warranty terms, form the applicable agreement relating to your transaction. Specific written promises made to you about your order remain part of that agreement.
